Usage and Privacy Policy
USER CONTENT AND PERSONAL AND SENSITIVE INFORMATION

This agreement ("Agreement") establishes the terms and conditions for the use of the services provided by Mobility Edge AI LLC and its affiliates ("Company"). By using the services offered by the Company, you ("App User") agree to abide by this Agreement.

User Content
​
1.1. App User may post, upload, or submit images, photos, audio, video, and/or other types of content in connection with the Services ("User Content"). App User is solely responsible for all User Content, including all approvals, consents, and authorizations from third parties necessary for the User Content.
1.2. If the App User submits User Content, it may become publicly available and may be shared with third parties, including but not limited to Mobility Edge AI LLC's clients, clients of Mobility Edge AI LLC's clients, and third-party service providers.
1.3. User Content must not contain copyrighted or marked content or material from third parties, nor audio, video, images, or likenesses of any person other than the App User.
1.4. The App User will not receive compensation for User Content. The App User remains the owner of their User Content.
1.5. By using, uploading, posting, or submitting User Content in connection with the Services, the App User grants Mobility Edge AI LLC (and/or Mobility Edge AI LLC's clients) a perpetual, irrevocable, unlimited, transferable, sublicensable, worldwide, and royalty-free right and license to edit, copy, transmit, publish, display, create derivative works, reproduce, distribute, and otherwise use, modify, or distribute their User Content in any manner, without compensation or notice.
1.6. The App User is solely responsible for User Content. Mobility Edge AI LLC cannot review all User Content. Mobility Edge AI LLC reserves the right to delete, move, or edit User Content that, at the sole discretion of Mobility Edge AI LLC, is deemed to:
(i) violate these Terms;
(ii) violate copyright or trademark laws; or
(iii) be abusive, defamatory, obscene, or otherwise unacceptable.

2. Personal and Sensitive Information
2.1. Mobility Edge AI LLC does not aim to collect personal information (except location information and other smartphone sensor data), and if such information is provided or captured, it is used only to fulfill obligations arising from the provision and improvement of our services and for other purposes described in this Privacy Policy.
2.2. This section describes the types and categories of personal information we may receive or collect, and the next section of this Privacy Policy below describes how we may use this information.

3. Information Provided by Users or Clients

3.1. When you download a mobile application developed by Mobility Edge AI LLC and related companies, create a Sandbox or Sentinel account, or subscribe to the Service, we may receive or collect one or more of the following items: name, address, email address, company name, market vertical, country, phone number, account password, payment information, credit card information, and other billing data.
3.2. For example, you may provide personal information directly to us in connection with registration, sign-up, or interaction with Mobility Edge AI LLC or our partners/clients through the use of the Service, when you create an account for services, when you subscribe to email alerts, updates, or newsletters, or when you respond to a survey, fill out a form, or complete or update any user or client profile through the Service.

4. Client's Client Data

4.1. Client's Client Data consists of personal and non-personal information collected from the Client's clients as a result of the use of Client's services, which is then received or collected by the Company in connection with the Services ("Client's Client Data").
4.2. You agree not to provide or arrange for us to access—through the use and implementation of our Services or otherwise—any Client's Client Data that we do not have permission to use in accordance with this Privacy Policy, other applicable agreements, or any applicable law.
4.3. As a result of using the Service, we may collect the following Client's Client Data: individual's gender, city or state of residence, age, characteristics, driving behavior, driving locations, and driving activities, as well as data about specific trips taken, types of vehicles used, and similar information.
4.4. We collect, receive, and store non-identifying data when you provide it directly to us through the Services, or when a Client's client provides it through the use of the Client's services that employ or are connected to the Services. The Client may choose to share additional Client's Client Data with us, such as name, email address, and other information, which will then identify the user associated with the Client's Client Data.
5. Automatically Collected Information

5.1. We may receive, collect, generate, and store certain types of information whenever you use the Service, as well as when Client's clients use the Client's services or otherwise interact with us.
5.2. For example, one of our applications or Services may collect data about driving activities, and our Services may then analyze this data and generate derived or aggregated data, as well as reports and other outputs.
5.3. As another example, we may automatically record your activity when using the Service, such as the date and time of your activities, your IP address, browser type, internet service provider, page views, domains, operating system, and similar information.
5.4. Additionally, we may automatically send and receive information to and from a computer, mobile phone, or other devices in connection with the use of the Services.
5.5. Like many websites and online services, we may also use "cookies" (see the section below titled "Our Use of Cookies" for more information), log files, web beacon technologies, and other automated tools to obtain certain types of information when a web browser, mobile application, or other applications access the Services.
5.6. This information helps us provide the Service and design and improve the Service to better assist our users.
6. How Are the Information Used?
6.1. The Company may use the information submitted, collected, received, or generated from or about you or Client's clients for any of the following purposes:
6.2. We receive and analyze smartphone location data to detect the start and end of driving. When the system detects driving, the mobile application or Telematics SDK as part of the mobile application begins recording trip data (precise Telematics data related to the trip), such as location, speed, time, accelerometer data, gyroscope data. The collected data is used for subsequent analyses described below:

Interpreting Telematics data collected into vehicle movement data, including driving behavior, location, trips, and points of interest;

To operate, provide, administer, develop, and enhance the Service, as well as to operate and support the Company's related business;

To better understand how you and Client's clients access and use the Services on an aggregated and individualized basis, to track and monitor usage, to conduct quality control, to correct technical errors and other issues, as well as to conduct market research and respond to user wants and preferences;

To analyze, compile, publish, sell, and otherwise market information (except personal information, unless de-identified or anonymized), including, but not limited to, derived and analytical information, related to the use and users of the Services. The foregoing includes, for example, the Company's distribution or sale of aggregated, de-identified, or non-identifying data, or the use of de-identified or non-identifying data to provide products or services to third parties;
To provide personalized experiences and recommendations, language and location customization, personalized help and instructions, or other responses to the use of our Services;
To provide user support and handle inquiries;
To communicate or contact you about the use or participation in the Services, and for other customer service purposes; this may include using email addresses to send messages and notices for the purposes described above and below;
To offer content, services, or other products and services, including the development of new services and products;
To comply with applicable laws, rules, and regulations and any regulatory mandate or court order;
To enforce our Terms of Service, as well as other applicable agreements, rights, and remedies;
To protect the safety of any person, address fraud, security or technical issues, or protect the rights or property of the Company;
To use in any other way or for any other purpose for which you have given permission or consent to the Company.

7. Sharing and Disclosure of Information

7.1. Information provided by our users is an important part of our business. The Company will share and disclose information submitted, collected, received, or generated from or about you or from or about Client's clients only as compatible with the purposes described in this Privacy Policy and as permitted by law.
7.2. Information is shared with or disclosed to others in the following ways:
Aggregated Data and Anonymous Data: The Company may publish and otherwise disclose on an aggregated basis information (including derived and analytical information) related to the use and users of the Services. The Company may also publish and disclose information that does not contain personal information or that is de-identified and not connected to an individual's or entity's name or similar information that would enable the specific identification or contact of someone;

Company Affiliates: We may share your Client and Client's Client Data with our subsidiaries and other affiliates, but only if these entities are subject to this Privacy Policy or follow practices at least as protective as those described in this Privacy Policy;

Public Forum: Any User Content or other user information, content, or materials submitted, posted, shared, transmitted, or otherwise provided to public portions of the Service may be shared with the public without restrictions. The Company also reserves the right to publish or make publicly available any information that is already publicly available before the first supply or collection by the Company or information that becomes publicly available without any action or omission by the Company;

Contractors, Collaborators, and Agents: We may employ other companies and individuals to perform functions or services for the Company or otherwise act on our behalf. These third parties may have access to personal information and other information necessary to perform their functions on our behalf. We make reasonable efforts to require these companies (1) to provide adequate protections for personal information that are no less protective than those set out in this Privacy Policy and (2) to use personal information only for the purposes for which the third party was engaged by us. We are not responsible for the acts or omissions of these third parties, except as provided by applicable law;
Business Transfers and Collaborations: As we continue to develop our business, we may sell the Company or its business or assets or buy or sell online sites, services, subsidiaries, or other businesses; or we may collaborate or partner with other companies in strategic transactions, business deals, or licenses. In such transactions, customer and user information and information about the use of the Services (including, but not limited to, Client Data, User Content, and Client's Client Data) would generally be one of the transferred business assets or otherwise one of the components or involved in the transaction; therefore, we may share this information in connection with such transactions or agreements;
Law Compliance and Protection of the Company and Others: We reserve the right to disclose personal information and any other information when we believe disclosure is appropriate to comply with the law, a court proceeding, court order, subpoena, or other legal process; detect, prevent, or address fraud, security issues, emergency situations, or technical issues; enforce or apply our Terms of Use, as well as other applicable agreements, rights, and remedies; or protect the rights, property, or safety of the Company, our employees and contractors, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.
7.3. The Services may include or interoperate with applications, services, features, or functionalities provided by third parties. In connection with such third-party applications, services, features, or functionalities, you may submit (or third parties may access) certain information about you or your activities related to those applications. The use, storage, and disclosure of this information by these third parties are subject to their own privacy policies.
8. PERSONAL AND SENSITIVE INFORMATION
8.1. IN THE EVENT WE RECEIVE FROM OUR CLIENTS OR USERS OF APPLICATIONS OR COLLECT ANY PERSONAL OR SENSITIVE DATA, MOBILITY EDGE AI LLC AND AFFILIATED PARTIES SHALL NOT:

Extend the use of received data and use it beyond the purpose described in the section "How Are the Information Used."
​
Handle all personal or sensitive user data securely, including transmission using modern encryption (via HTTPS).
​
Use a runtime permission request whenever available before accessing data protected by Android permissions.
​
Not sell users' personal or sensitive data.
